1. Introduction
This Privacy Notice ("Notice") provides details about BALMUDA Inc.'s ("Balmuda", "we", "us" and "our") processing of your personal data in respect of its European e-commerce business, including how and why we use your personal data and how we keep it safe. It also explains the rights you have over your personal data and how to contact us. You should read this Notice so that you know what we do with your personal data.
This Notice applies to our processing of your personal data when you are a customer or prospective customer, website visitor, a subscriber to our news and offers or otherwise communicate or engage with us in respect of our European e-commerce business ("you" or "your"). It covers the United Kingdom and all jurisdictions in the European Economic Area in which we operate and/or in which, or to which, we offer our goods or services.
Please note that our merchant of record, Global-E Japan KK ("Global-E"), acts as a separate and independent controller of your personal data. It uses the personal data it receives from us, and that you provide directly to it, for its own purposes, including to process payments, manage transactions and deliver our goods to you. Global-E is responsible for its own compliance with data protection law when it processes your personal data as our merchant of record. 2. Explanation of terms
In this Notice:
- "personal data" means any information that relates to you from which you can be directly or indirectly identified;
- "process" means any activity relating to personal data, including collection, use, sharing, storage and transmission; and
- "controller" is a legal term and refers to the company that makes decisions about how and why your personal data is processed and is therefore responsible for ensuring that the processing is done in accordance with relevant data protection laws. Balmuda is the controller of the personal data processed as described in this Notice.
3. What information do we collect?
We obtain your personal data directly from you when you visit our website, purchase our products or otherwise engage with us. Data may also be provided from third party sources (such as our merchant of record, third party service providers or your bank).
We collect personal data about you, including the following:
- Identity and Contact Information, such as name, title, delivery address, email address and telephone numbers. We may also request ID (e.g. identity card or passport number).
- Financial Data: payment card (partial number only)/bank account details, billing information (including billing address) and payment history information. Payment is handled by our merchant of record, so we'll only process financial data in limited cases for customer support purposes.
- Product information, such as details of the products you have purchased from us and your interests in relation to our products and services.
- Information collected when you contact us: includes information in emails and other communications with us, such as in respect of your general enquiries, reviews, feedback, complaints, surveys you complete and prize draws/competitions in which you take part.
- Preferences: Preferred language/use of Google translate function and direct marketing and cookie preferences.
- Technical Data: identifiers such as internet protocol (IP) address, browser and website browsing and search history.
We will not process any special categories of personal data (for example, information about your health or racial or ethnic origin) unless you voluntarily provide this to us.

5. Anonymous data
We may create anonymous and aggregated data sets and reports in order to assess, improve and develop our business, products and services and for other research, marketing and analytics purposes. We may also share this anonymised data with third parties. This data will not constitute personal data and therefore will not identify you or make you identifiable.
6. Data sharing
We may share your personal data with the following categories of third parties:
- other Balmuda group companies;
- our merchant of record, Global-E and other business partners;
- third party suppliers and service providers, such as IT support, maintenance, back up and website hosting, operation and maintenance providers, commerce platform providers, sales strategy, branding and web design providers, courier/delivery companies, address providers, logistics warehousing providers, marketing and advertising services providers and our after-sales service provider;
- our professional advisers and consultants (e.g. lawyers, auditors, actuaries, bankers, insurers, brokers and accountants);
- credit reference agencies and fraud prevention agencies;
- financial regulation authorities, government tax departments and other government departments and agencies, data protection regulators and any other applicable regulators;
- law enforcement agencies, fraud prevention agencies, anti-money laundering agencies, courts and court-appointed persons or entities;
- third parties with which you ask us to share your personal data, such as your bank; and
- purchasers or potential purchasers of any Balmuda group company and the management of companies that we acquire or may acquire.
7. For how long do we keep your personal data?
We will only keep your personal data for as long as is reasonably necessary for the relevant purposes set out in this Notice or when we are obliged to do so in order to comply with legal or regulatory requirements. The amount of time we retain your personal data for depends on the nature of the personal data and the purpose for which it is processed. Once the data is no longer required, it will be securely deleted.
8. Sending Personal Data outside the UK/EEA
We may transfer your personal data outside the UK or European Economic Area (EEA) (including to our group companies in Japan and the US and our merchant of record in Japan).
If we make such transfers, we will ensure the confidentiality and protection of that information through compliance with applicable data protection legislation. Either the relevant country's data protection laws will have been approved by the UK government or European Commission (as applicable) as being adequate to protect your personal data or we will ensure other appropriate safeguards are in place, such as (as applicable) the UK's International Data Transfer Agreement or Addendum or the European Commission's Standard Contractual Clauses. 9. How does the Company protect your personal data?
The Company takes the security of your personal data very seriously. The Company has put in place security measures, policies and controls to protect your personal data from accidental or unlawful destruction, damage, loss, alteration or unauthorised disclosure or access.
Please be aware that the security of the transmission of information via the Internet cannot always be guaranteed. If you have reason to believe that your interaction with us is no longer secure (for example, if you feel that the security of your account has been compromised), please immediately notify us using the details below.
10. Your Rights
Data protection law gives you specific rights in relation to your personal data, as follows:
- Right of access: If you ask us, we will confirm whether we are processing your personal data and, subject to certain conditions, we will provide you with a copy of that personal data along with certain other details such as the purpose(s) of the data processing.
- Right to rectification: If your personal data is inaccurate or incomplete, you are entitled to ask that we correct or complete it. Please help us to keep your personal data up to date by letting us know of any changes to your contact information (e.g. your delivery address) as soon as possible.
- Right to erasure: Subject to certain conditions, you may ask us to delete or remove your personal data, such as where we no longer need the personal data for the purposes for which it was collected or our legal basis for the processing is your consent and you withdraw consent.
- Right to restrict processing: You may ask us to restrict or 'block' the processing of your personal data in certain circumstances, such as where you contest the accuracy of the personal data or object to us processing it. We will tell you before we lift any restriction on processing.
- Right to data portability: You have the right to obtain from us (or to have transferred to another controller) your personal data that we process by automated means on the basis of your consent or necessity for a contract with you. We will provide the personal data in a structured, commonly used and machine-readable format.
- Right to object: You may object to our processing your personal data, and we will stop processing your personal data if (i) we are relying on a legitimate interest to process your personal data, unless we demonstrate compelling legitimate grounds for the processing or the personal data is being processed for the establishment, exercise or defence of legal claims or (ii) we are processing your personal data for direct marketing purposes.
- Right to withdraw consent: If we rely on your consent to process your personal data, you have the right to withdraw that consent at any time. This will not affect the lawfulness of processing of your personal data carried out before we received notice that you wished to withdraw your consent.
- Right to make a complaint: If you have a concern about our privacy practices, including the way we handle your personal data, we would appreciate the opportunity to put it right. However, you also have the right to lodge a complaint with the data protection regulator in your jurisdiction:

You may also contact us if you are unsure whether Balmuda or Global-E is responsible for a particular processing activity. Where your request relates to processing of your personal data carried out by Global-E, we may need to refer you to Global-E for further assistance from them.
